Terms of Service

These Terms of Service (“Terms”) govern your use of the itoms platform operated at app.ito.ms (“Service”). By creating an account or using the Service, you agree to these Terms.

1. Definitions

  • “Platform” means the itoms web application, APIs, embed widgets, and standalone pages
  • “Project” means a content workspace on itoms, identified by a unique slug
  • “Content” means any videos, articles, images, audio, shouts, polls, or other materials uploaded to the Service
  • “User” means any individual who creates an account on the Service
  • “Subscriber” means an end user who subscribes to receive email updates from a Project

2. Account Registration

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to create an account
  • One person or entity per account — accounts may not be shared

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Upload or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Infringe on any third party's intellectual property rights
  • Distribute spam, malware, or unsolicited commercial messages
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with the Service's infrastructure or performance
  • Use automated means to access the Service except through our official APIs
  • Resell or redistribute the Service without our written permission

4. Content Ownership and License

4.1 Your Content

You retain full ownership of all Content you upload to itoms. By uploading Content, you grant itoms a non-exclusive, worldwide license to host, store, transmit, and display your Content solely for the purpose of operating and providing the Service to you.

4.2 Content Responsibility

You are solely responsible for the Content you publish. You represent and warrant that you have all necessary rights to publish your Content and that it does not violate any third party's rights.

4.3 Content Removal

We reserve the right to remove Content that violates these Terms. Where possible, we will notify you before removal.

5. Social Media Publishing

5.1 Third-Party Platform Integration

The Service allows you to connect your Instagram and TikTok accounts to publish content directly. By connecting a social media account, you:

  • Authorize itoms to store encrypted OAuth tokens for the connected account
  • Acknowledge that publishing is initiated only by your explicit action
  • Agree to comply with the connected platform's terms of service and community guidelines
  • Understand that you can disconnect at any time, which immediately deletes stored tokens

5.2 AI-Generated Captions

The Service offers AI-generated captions for social media posts. These captions are suggestions only — you are responsible for reviewing and editing captions before publishing. itoms is not responsible for the content of AI-generated text.

5.3 Platform Compliance

You are responsible for ensuring that content published through itoms complies with Instagram's and TikTok's respective terms, content policies, and community guidelines. itoms is not liable for content that is removed or restricted by third-party platforms.

6. Multi-Tenancy and Project Access

  • Each Project is a separate workspace with its own content, settings, and team
  • Project owners can invite team members with roles: owner, admin, or viewer
  • Data is isolated between Projects — members of one Project cannot access another Project's data unless explicitly shared
  • Project owners are responsible for their Project's content and subscriber communications

7. Email Subscribers

If your Project collects email subscribers, you agree to:

  • Only send relevant content to subscribers who have opted in
  • Honor unsubscribe requests promptly (handled automatically by the platform)
  • Comply with applicable email marketing laws (CAN-SPAM, GDPR, etc.)
  • Not import or add subscribers without their consent

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned downtime.

9. Account Deletion

You may delete your account at any time from your Account settings. Upon deletion:

  • All Projects you own and their content will be permanently deleted
  • All social media connections and tokens will be immediately removed
  • Subscriber data for your Projects will be deleted
  • This action is irreversible

We may also suspend or terminate accounts that violate these Terms, with notice where practicable.

10. Limitation of Liability

To the maximum extent permitted by law, itoms shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid (if any) for the Service in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing formal legal remedies.
